Definitions & Applicability
- These terms and conditions apply to all offers, orders, and agreements of AZARINA, unless AZARINA has explicitly agreed to different terms in writing.
- Any deviations that may have been agreed upon cannot be used to claim rights for future transactions.
- Accepting an offer and placing an order means that you accept the applicability of these terms.
Prices & Costs
- All prices listed on the AZARINA website are inclusive of 21% VAT. All items are shipped free of charge within the Netherlands and internationally.
In the case of a return, transaction fees will be charged. Klarna reserves the right to refuse an order. - As long as the agreement has not been concluded, AZARINA is entitled to modify the prices and further terms.
- Typographical and printing errors are excepted.
Liability
- AZARINA, its employees, and its products are not liable for any damages of any kind, whether direct or indirect, from the moment the product is delivered to the customer. AZARINA is also not liable for any damages caused by third parties during the execution of the agreement.
- AZARINA does not accept any liability for damages arising from the use of AZARINA's products.
- AZARINA's liability is always limited to a maximum of the purchase price of the relevant item.
- AZARINA is not liable for misunderstandings, mutilations, delays, or failure to properly convey orders and communications due to the use of the Internet or any other communication method between you and AZARINA or between AZARINA and third parties, regarding the relationship between you and AZARINA, unless there is intent or gross negligence by AZARINA.
Force Majeure
- In a case of force majeure, AZARINA's obligations are suspended. If the period of force majeure exceeds two months, both you and AZARINA have the right to terminate the agreement without any obligation to pay compensation. Force majeure includes, but is not limited to, strikes, breakdowns, import/export bans, regardless of whether this occurs with AZARINA or its suppliers.
Applicable Law
- The agreement and these terms and conditions are exclusively governed by Dutch law.
